
Top 4 Essentials if You are (or are about to be) Sued!
If you are staring down the barrel of a demand letter or lawsuit, we recommend you do these 4 things right away:
(1) Immediately put a “litigation hold” on the destruction of all forms of electronic evidence, including pausing routine deletions of audio, video, e-mails and texts and quarantine all electronics used by the employee.
(2) Contact your insurance broker to confirm whether you have employment practices liability insurance or some other form of insurance coverage.
(3) Gather the employee’s personnel file and payroll records along with all relevant documents (such as contracts and communications).
(4) Create a timeline of important and relevant events and a list of critical witness and what they know. Your lawyer will need it!
